SERVICE CONTRACT
This agreement is valid between BDI METAL and real or legal persons requesting calibration services from BDI METAL (hereinafter referred to as the “Customer”), and the following terms shall be deemed accepted by the Customer.
Service Request and General Conditions
-
Calibration service requests must be made in writing, and the Calibration Request Form must be completed in full. Signing the offer form indicates acceptance of this service agreement.
-
For on-site calibrations, the date is determined by mutual agreement. Travel and accommodation costs are included in the price. If the number of calibrations decreases or the duration extends more than one (1) business day due to reasons not caused by BDI Metal, unperformed calibrations will be invoiced appropriately depending on the nature of the work, location, and the scope of the offer.
-
Discounts may be offered for bulk calibrations, and the quoted price will be valid only if all devices listed in the package are calibrated. If not all listed devices are calibrated, the discount may vary depending on the number of calibrations and workload.
-
For calibrations performed at the customer’s facility, the Customer is responsible for ensuring all necessary conditions are met.
-
User manuals, service booklets (if any), special warnings, required adapters, cables, and the most recent calibration certificate (if applicable) must be ready and available at the time of calibration.
-
If the calibration method is not specified by the Customer, calibrations within the scope of accreditation will be carried out according to the approved procedures of the accreditation.
-
For on-site calibrations, it must be clearly stated during the quotation phase whether travel and accommodation expenses of BDI METAL personnel will be covered by the Customer or by BDI METAL
Payment Terms
-
Prices do not include VAT. The quoted fee covers only the calibration process.
-
Unless otherwise stated, payment is collected in advance. Payments can be made via bank transfer or EFT to the bank account number indicated on the invoice.
Contract and Service Modifications
-
Requests for amendments by the Customer must be communicated before the calibration begins.
-
Requests for changes during calibration may be accepted if technically feasible and time permits.
-
If any situation arises outside the scope of the agreement, the customer will be contacted and informed. Relevant records will be maintained with the Request/Offer form.
Calibration and Reporting
-
If the calibration method is not specified by the Customer, the service will be carried out in accordance with the approved procedures within the scope of accreditation or applicable national/international standards.
-
The calibration interval is indicated on the report and label according to the calibration method.
-
Calibration reports do not imply product approval. The information in the reports represents only the calibration values of the device and cannot be used for any other purpose. Evaluation is the responsibility of the Customer.
-
The calibration report is delivered to the Customer after the invoice issued post-calibration is fully paid.
-
The Customer may request repetition of a calibration process they find questionable. The calibration fee must be paid for this. If the issue arises from an error by BDI METAL, no fee will be charged for the second calibration.
Dispute Resolution
-
In case of a dispute between the Customer and BDI METAL, efforts shall be made to reach a mutual resolution. If unresolved, TÜRKAK will be notified to provide assistance with appropriate methods. If the Customer remains unsatisfied, legal proceedings may be initiated. In such cases, the competent jurisdiction shall be the Courts and Enforcement Offices of Kadıköy, Istanbul.
Confidentiality and Information Security
-
BDI METAL undertakes to adhere to the principles of impartiality and confidentiality throughout all stages of calibration.
-
BDI METAL is responsible for the management of all information obtained or generated during the calibration activities, in accordance with legal obligations.
-
If BDI METAL is legally obligated or contractually authorized to disclose any confidential information, the Customer or relevant individual will be informed about the disclosure, unless prohibited by law.
